Our company is registered in the National Court Register of Entrepreneurs kept by S\u0104D REJONOWY DLA M.ST. WARSZAWY W WARSZAWIE, XIII WYDZIA\u0141 GOSPODARCZY KRAJOWEGO REJESTRU S\u0104DOWEGO under KRS number 0000997093.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">1. Scope<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Our terms apply to all orders placed via our online shop. These Terms also apply to businesses for future commercial relations without the need for any formal expression thereof. Unless expressly approved by us to the contrary, we cannot accept the contractual validity of any conflicting or complementary general terms and conditions used by any busi<sup><\/sup>ness.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. Contractual partner, formation of contract, options for corrections<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The contract is concluded with Hogai Sp. z o. o.. By placing the products in the online shop, we make a binding offer on our part to enter into a contract regarding those items. You may place our products in the shopping basket without obligation and amend your entries at any time prior to submitting your binding order by using the correction facilities that are provided for this purpose and explained during the ordering process. The contract is formed by clicking on the order button which indicates your acceptance of our offer concerning the goods contained in<sup><\/sup> the shopping basket. Once you have sent your order you will immediately receive a confirmation via e-mail.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3. Contract language, saving of the contract text<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The language(s) available for concluding the contract: Polish, English. We save the text of the contract and forward the order data and our Terms and Conditions to you on a durable medium. You may also view the text of the contract in our customer login area.<sup><\/sup><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4. Delivery conditions<sup><\/sup><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Delivery cost<sup><\/sup>s may apply to the product prices displayed. Further information on delivery costs, if applicable, are explained within individual product offers.<sup><\/sup> We only dispatch goods en route; pick up by the customer is not possible. We do not deliv<sup><\/sup>er to a parcel locker.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5. Payment<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The following payment methods are basically available in our online shop. Credit Card \/ Electronic Payments via Autopay. With the submission of the order, you provide your payment details. After your identification as the legal cardholder or authorized user, the payment transaction is automatically carried out and charged.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6. Right to cancel (Returns)<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>6.1. General Conditions and Deadlines<\/strong><\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>A Buyer who is a Consumer (including an individual running a sole proprietorship purchasing goods for purposes not related to their professional trade or business activity, under applicable laws \u2014 the so-called Quasi-consumer) has the right to withdraw from the sales contract concluded at a distance within <strong>14 calendar days<\/strong> without giving any reason.<\/li>\n\n\n\n<li>For all other businesses (pure B2B commercial transactions), the voluntary right to cancel without a cause is excluded.<\/li>\n\n\n\n<li>The cancellation period begins on the day on which the Buyer, or a third party designated by the Buyer (other than the carrier), takes physical possession of the goods.<\/li>\n\n\n\n<li>To exercise the right to cancel, the Buyer must inform the Seller of their decision by means of an unequivocal statement before the expiry of the 14-day period. The statement may be submitted, among others:\n<ul class=\"wp-block-list\">\n<li><strong>By electronic mail (e-mail):<\/strong> to <code>myorder@hogai.store<\/code> or <code>complains@hogai.store<\/code><\/li>\n\n\n\n<li><strong>In writing (by post):<\/strong> to the address: Hogai Sp. z o. o., ul. Ksawer\u00f3w 21, 02-656 Warszawa, Poland.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>6.2. Return Procedure and Buyer\u2019s Liability<\/strong><\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>The Buyer must send back the goods or hand them over to the Seller immediately, and in any event no later than <strong>14 days<\/strong> from the day on which they communicated their decision to withdraw from the contract. The deadline is met if the Buyer sends back the goods before the period of 14 days has expired.<\/li>\n\n\n\n<li>All returns should be sent to the following delivery address of Hogai return warehouse: <strong>Hogai Sp. z o. o., ul. Lucerny 39, 04-685 Warszawa, Poland<\/strong>. The direct costs of returning the goods shall be borne by the Buyer.<\/li>\n\n\n\n<li><strong>Liability for the depreciation of goods:<\/strong> The Buyer is liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics, and functioning of the goods. If the returned product bears clear signs of use exceeding the above limits (e.g., paint chips, scratches, abrasions), the Seller reserves the right to reduce the refunded amount proportionally to the actual drop in the product&#8217;s value.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>6.3. Refund of Payments<\/strong><\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>In the event of a valid contract withdrawal, the contract is deemed void.<\/li>\n\n\n\n<li>The Seller shall refund all payments received from the Buyer, including the costs of delivery (with the exception of supplementary costs resulting from the Buyer&#8217;s choice of a type of delivery other than the least expensive type of standard delivery offered by the Seller), without undue delay and in any event not later than <strong>14 calendar days<\/strong> from the day on which the Seller is informed of the Buyer&#8217;s decision to withdraw.<\/li>\n\n\n\n<li>The Seller will carry out such reimbursement <strong>using the same means of payment<\/strong> as the Buyer used for the initial transaction (including the <strong>Autopay<\/strong> system, if the order was paid via this method), unless the Buyer has expressly agreed otherwise; in any event, the Buyer will not incur any fees as a result of such reimbursement.<\/li>\n\n\n\n<li>The Seller may withhold reimbursement until the Seller has received the goods back or until the Buyer has supplied evidence of having sent back the goods, whichever is the earliest.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">7. Retention of title<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The goods shall remain our property until full payment is made. For businesses, the following applies additionally: We reserve ownership of the goods until complete settlement of all claims arising from a current business relationship. You may resell reserved goods in ordinary business operations; you shall ass<sup><\/sup>ign any claims arising from this resale \u2013 irrespective of connecting or mixing of the reserved goods with a new item \u2013 in the amount<sup><\/sup> of the invoice amount to us in advance, and we a<sup><\/sup>ccept this assignment. You remain authorised to collect the claims; however, we may likewise collect the claims ourselves, should you fail to fulfil your payment obligatio<sup><\/sup>ns.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">8. Damage during delivery<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">For consumers the following applies: If the goods are delivered with obvious damage caused during delivery, please report the defect to the carrier and notify us without delay. Failure to make a complaint or to make contact does not in any way affect your legal rights or the enforcement of <sup><\/sup>such rights, notably your warranty rights. However, in doing so you help us to assert our own claims against the carrier or<sup><\/sup> transport i<sup><\/sup>nsurer.<sup><\/sup><sup><\/sup> Applicable to businesses: The risks of accidental loss or deterioration of the goods will transfer to y<sup><\/sup>ou once we have submitted the it<sup><\/sup>em to the haulier, carrier or other contractor for forwarding to the defined person or establishment.<sup><\/sup> Furthermore, businesses are subject to the inspection and notification requirements set out in art. 563 \u00a7 1 of Kodeks Cywilny (Polish Civil Code). The purchaser must examine the goods immediately after their delivery by the vendor, as far as this is practicable in the ordinary course of business, and upon the discovery of any defect must immediately give notice thereof<sup><\/sup> to the vendor. Should you fail to comply with the instructions set out therein; the goods will be deemed to have b<sup><\/sup>een approved unless the defect was not detectable on inspection. This shall not apply if a given defect has been concealed by us decei<sup><\/sup>tfully.<sup><\/sup><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">9. Warranty and complaints (Conformity of goods with the contract)<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>9.1. Legal Basis and Consumer Rights<\/strong><\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>The Seller is under a legal duty to supply products that are in conformity with the contract and free from defects.<\/li>\n\n\n\n<li>In the event of a lack of conformity of the goods with the contract, a Buyer who is a Consumer is entitled to statutory rights under the laws of the country where the consumer has their habitual residence (incorporating EU Directive 2019\/771 on certain aspects concerning contracts for the sale of goods). In the first instance, the Consumer may demand the <strong>repair or replacement<\/strong> of the goods. If repair or replacement is impossible or would impose disproportionate costs on the Seller, the Consumer may request an <strong>appropriate reduction of the price<\/strong> or <strong>terminate the contract (cancel the order)<\/strong>.<\/li>\n\n\n\n<li>The Seller shall be liable for any lack of conformity of the goods with the contract that exists at the time of delivery and becomes apparent within <strong>2 years<\/strong> from that date.<\/li>\n\n\n\n<li>The provisions regarding Consumers in this section apply equally to an individual concluding a contract directly related to their business activity (Quasi-consumer), when the content of the contract indicates that it does not have a professional character for that person under applicable national commercial registries.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>9.2. Scope of Seller&#8217;s Liability and Product Specifics<\/strong><\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>The Seller&#8217;s liability for lack of conformity with the contract does not cover:\n<ul class=\"wp-block-list\">\n<li>a) mechanical damage occurring after the product has been delivered to the Buyer;<\/li>\n\n\n\n<li>b) damage resulting from impacts, drops, accidental handling, or any improper use inconsistent with the product&#8217;s intended purpose;<\/li>\n\n\n\n<li>c) natural wear and tear of materials resulting from standard operation;<\/li>\n\n\n\n<li>d) structural differences, grain patterns, knots, or color variations resulting from the natural properties of the organic materials used (specifically natural wood and veneer);<\/li>\n\n\n\n<li>e) damage to paint or lacquer coatings occurring during the day-to-day use of the product by the Buyer.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Painted products by the HOGAI brand require particular care during everyday use. Any paint chips, scratches, or flakes resulting from impacts, abrasions, or other mechanical actions caused by the user do not constitute a manufacturing defect and cannot form the basis of a warranty claim.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>9.3. Submission of a Complaint (Contact Details)<\/strong><\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>Complaints may be submitted by the Buyer in any preferred form. To ensure efficient processing, it is recommended to use the following communication channels:\n<ul class=\"wp-block-list\">\n<li><strong>By e-mail (preferred method):<\/strong> to the dedicated address: <code>complains@hogai.store<\/code><\/li>\n\n\n\n<li><strong>In writing (by post):<\/strong> to the corporate address: Hogai Sp. z o. o., ul. Ksawer\u00f3w 21, 02-656 Warszawa, Poland<\/li>\n\n\n\n<li><strong>By phone (customer support):<\/strong> via number: <code>+48 780 635 148<\/code> (The Customer Service office is open from Monday to Friday, between 11:00 am and 4:00 pm CET).<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>To allow proper verification, a correctly submitted complaint should include:\n<ul class=\"wp-block-list\">\n<li>the order number or another proof of purchase,<\/li>\n\n\n\n<li>a detailed description of the reported lack of conformity \/ defect,<\/li>\n\n\n\n<li>clear photographic documentation showing the defect explicitly as well as the overall condition of the item.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>9.4. Complaint Investigation Procedure (Autopay Verification Standards)<\/strong><\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>The Seller shall investigate and respond to the submitted complaint within a maximum period of <strong>14 calendar days<\/strong> from the date of its receipt. The Buyer will be notified of the decision via the same communication channel through which the complaint was filed, unless specified otherwise.<\/li>\n\n\n\n<li>Each complaint is assessed individually based on the presented factual circumstances and the attached documentation.<\/li>\n\n\n\n<li>The acceptance of a previous complaint from the same or another Buyer is case-specific and does not constitute a precedent for the automatic acceptance of subsequent or similar claims.<\/li>\n\n\n\n<li>If a complaint is rejected due to a lack of factory defects or if the damage was caused by user error, the Seller may \u2013 as part of its customer care policy \u2013 offer the Buyer a <strong>paid repair service<\/strong> or another alternative commercial solution.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>9.5. Commercial Guarantees<\/strong><\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>Detailed conditions regarding any additional commercial guarantees (e.g., manufacturer&#8217;s guarantee) provided for specific items are always enclosed with the product or published on dedicated informational pages of the online shop. Such a guarantee applies additionally and does not exclude, limit, or suspend the Buyer\u2019s statutory rights regarding the lack of conformity of goods with the contract.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>9.6. Provisions Applicable to Businesses (B2B)<\/strong><\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>For sales contracts concluded with Buyers holding the status of a Business \/ Entrepreneur (excluding sole proprietorships meeting the Quasi-consumer criteria set out in sub-clause 9.1.4), the Seller&#8217;s statutory liability under warranty for physical and legal defects (<em>r\u0119kojmia<\/em>) is <strong>entirely excluded<\/strong> pursuant to Art. 558 \u00a7 1 of the Polish Civil Code (<em>Kodeks cywilny<\/em>).<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">10. Liability<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">We shall in any case be liable without limitation for claims due to damages that have been caused by us, our legal representatives or legal agents \u2022 for injury to life, limb or health<sup><\/sup> \u2022 for deliberate or grossly negligent breach of duty<sup><\/sup> \u2022 for guarantee commitments, where agreed \u2022 towards consumer.<sup><\/sup> Except these cases, our civil law liability is limited to the foreseeable and direct damages at the time of cont<sup><\/sup>ract conclusion.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">11. Code of conduct<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">We have submitted to the following code(s) of conduct: Trusted Shops (<a target=\"_blank\" rel=\"noreferrer noopener\" href=\"https:\/\/www.trustedshops.com\/tsdocument\/TS_QUALITY_CRITERIA_en.pdf\">https:\/\/www.trustedshops.com\/tsdocument\/TS_QUALITY_CRITERIA_en.pdf<\/a>)<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">12. Online dispute resolution<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The European Commission provides a platform for online dispute resolutions (ODR) which can be accessed at <a target=\"_blank\" rel=\"noreferrer noopener\" href=\"https:\/\/ec.europa.eu\/consumers\/odr\/\">https:\/\/ec.europa.eu\/consumers\/odr\/<\/a>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">13. Final provisions<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">For businesses Polish law applies; the provisions of the UN Convention on Contracts of the International Sale of Goods are excluded.
